  • Been admitted to practice law in the US
  • 4+ years PQE either in a law firm or in-house (preferably with technology companies)
  • Experience litigating cases in one or more jurisdictions
  • Strong communication skills and cooperative team player. Lead with empathy and understanding while embracing diverse points of view. Flexibility to adapt and thrive in a fast paced environment
  • Ability to work cross-functionally, with lawyers and non-lawyers, to establish principled, thoughtful, and effective solutions efficiently and in an amenable manner

What the job involves

  • We’re looking for a Litigation Counsel to join our team responsible for responding to litigation matters and legal requests
  • As Litigation Counsel, you’ll work with our internal legal team, external counsel, and stakeholders across the company to handle ongoing lawsuits, respond to litigation threats, and assist in broader legal strategy
  • You’ll help Cloudflare navigate a diverse set of legal issues including intellectual property (e.g. , relating to Cloudflare’s role as an online intermediary), contracts and other business disputes, and labor and employment matters
  • Work with our existing litigation team to help formulate and implement litigation strategies
  • Evaluate and respond to litigation threats and legal matters
  • Help select, onboard, and manage outside counsel on all aspects of litigation (including factual development, briefings, hearings etc.)
  • Work cross-functionally to further develop Cloudflare’s approach to intermediary liability issues around the globe
  • Assist in responding to and working with government regulators and private organizations on issues relating to Cloudflare’s approach to abuse on our network
  • Communicate with business leaders across the company about ongoing litigation and litigation threats, and provide training and resources to address future legal risks

Our take

Cloudflare is a multi-service global network that provides web security and infrastructure, DDoS mitigation services, and a content delivery network. Founded in 2009, Cloudflare has risen to become an industry giant, with around 25 million global internet properties on its network.

Cloudflare has been responsible for a number of admirable initiatives, offering free web protection to human rights groups, journalists, artists, and US election websites. This goes some way to counteracting the flak Cloudflare has received in some circles for the controversial groups and users who use its services. This chequered history, however, has not affected its over 80% market share in the content delivery network field.

This is perhaps in part because it has proven sharp at staying abreast of the rapidly morphing tech and digital space and customer demands. For example, Cloudflare is shifting to 100% renewable energy usage to create a zero-emissions internet, and in 2020 released a feature that would help users navigate data privacy regulations by selecting where their data is stored.

The cloud infrastructure market reached $53 billion in 2022. While the Big 3 (Amazon, Microsoft, and Google) own 65% of the market, that still leaves billions of dollars left for companies such as Cloudflare. Its ambitious and successful work is likely to continue being a crucial feature of the web, but in 2023, placed it in the crosshairs of hackers looking to exploit its infrastructure. The beginning of 2024 saw Cloudflare vow to bolster its security and patch vulnerabilities.
