Role

Who you are

  • We’re seeking an attorney with significant product counseling and/or in-house tech company experience that is eager to lead the product counseling function at OpenSea
  • Member of a US State Bar
  • JD from an ABA-accredited law school
  • 6+ years of relevant work experience
  • Product counseling experience, including in-depth experience working with Product and Engineering teams
  • Experience in the cryptocurrency, web3, financial services, or payments spaces
  • Experience drafting and negotiating agreements
  • Experience working with outside counsel in international contexts

Desirable

  • At least one of the following work experiences:
  • Top law firm or state or federal clerkships
  • Consumer protection or financial regulator at the state or federal level
  • In-house legal teams at technology companies
  • Experience designing and implementing privacy programs

What the job involves

  • Join OpenSea’s nimble legal team and influence the legal, product, and business strategy for a leading web3 marketplace
  • This cross-functional role blends product, regulatory, and commercial counsel responsibilities, and requires an autodidactic mindset to tackle legal issues in collaboration with a range of internal teams
  • This position is fully remote and reports to the General Counsel
  • Provide end-to-end product counseling on new products in partnership with a range of internal teams, including Product, Engineering, Business, Data Science, Trust & Safety, CX, Comms, and Marketing
  • Offer thought leadership and strategic direction to the executive team on novel web3 and blockchain technology legal and regulatory issues
  • Ensure product compliance with relevant US and international laws and regulations
  • Help build a world-class legal team, including mentoring and managing legal team members, hiring, and taking ownership of initiatives to enhance the team’s overall impact
  • Research novel legal questions and provide clear, creative, and actionable guidance to internal clients
  • Draft terms of use, privacy policies, product disclosures, and design policies required to support legal frameworks

Our take

OpenSea is a peer-to-peer digital marketplace for NFTs or uniquely identifiable digital items. These items are authenticated with blockchain and are part of a new internet economy that consists of digital products representing art, game characters, domain names, and event tickets.

The OpenSea platform allows users to both purchase NFTs or list digital items for sale. The platform initially encountered speed issues when NFT trading boomed due to the limitations of the Ethereum blockchain technology it was using. However, the company has transitioned to a new blockchain system, Polygon, which has mitigated the problem.

In the wake of the FTX collapse the NFT world has been shaken up, and new competitors have arisen to take advantage of the disruption. One such rival, Blur, has recently overtaken OpenSea's market lead. This has led to OpenSea changing its policies and fee structures to be more favourable to creators in a bid to retake its crown. It remains to be seen whether Blur and other rivals will be able to keep up the pressure, but it's clear that OpenSea will need to innovate if it wants to remain at the head of the market.
